Under the leadership of VERIAN (formerly KANTAR Public) and in collaboration with NTT Data and SMIT-VUB, Milieu will carry out a study for DG CNECT on contractual practices affecting the transfer of copyright and related rights and the ability of authors and producers to exploit their rights.

Despite the protection of the Digital Single Market Directive, non-EU streamers and broadcasters are increasingly resorting to buy-out contracts, imposing choice of law clauses and requiring the retention of copyright and related rights, creating challenges for authors and producers.

In this study, Milieu will map and analyse the EU, international and national rules applicable to such contractual practices and identify potential legal gaps.
