Conformity checking of measures of Member States to transpose Directives in the sector of the Environment and Climate Change – Service request DG Environment 1st round 2014

According to Article 258 of the TFUE, the Commission must ensure that the Member States fulfil their obligations under the Treaties. As such, it must check that the EU environmental Directives are fully and correctly transposed in the EU-28.
This contract resulted from the fifth call-down issued by DG Environment under the Framework Contract held by Milieu to check the conformity of measures adopted by Member States to transpose Directives in the sector of the Environment and Climate Change. It involved completing tables of concordance and drafting 43 conformity studies for directives from different sectors of the environment, including chemicals and air.
This project focused principally on Directive 2003/35/EC by weighing public participation in respect to certain plans and programmes that relate to the environment, and in particular the transposition of its Articles 3.7 and 4.4 relating to access to justice in matters related to the EIA and IED Directives. The analysis covered the 28 Member States. In addition, two Directives were covered for several countries (Industrial Emissions Directive – 4 countries) and Directive 2010/63/EU (Laboratory Animals Directive- 6 countries).
The Commission used these studies as background information in its function to ensure accordance with Article 258 of the TFUE.
