Conformity checking of measures of Member States to transpose Directives in the sector of the Environment and Climate Change

In accordance with Article 258 of the TFEU, the Commission shall ensure that the Member States fulfil their obligations under the EU Treaties, including by ensuring that EU Directives are fully and correctly transposed in the Member States. Milieu is holding a four-year framework contract to analyse the transposition of directives in the sector of environment and climate change in the 28 Member States and Iceland.
This involves completing tables of concordance and drafting conformity studies for Directives from different sectors of the environment (waste, water, air, general environmental issues) and in the area of climate change. The Commission uses these studies as background information to fulfil their obligations in the context of Article 258.
For the first call down (DG CLIMA- April 2013 – January 2014), Directive 2008/101/EC amending Directive 2003/87/EC so as to include aviation activities in the scheme for greenhouse gas emission allowance trading within the EU was analysed for all 28 Member States.
The second call down (DG ENV, April 2013 – January 2014) involved the completion of 34 studies for directives from different sectors of the environment. The focus of the second call-down was on the transposition of Directives 2010/63/EU on the protection of laboratory animals (covering 11 countries), 2008/56/EC on the Marine Strategy (9 countries) and 2008/98/EC (Waste Framework Directive- 5 countries).
The checking of transposition of Directive 2010/75/EU (Industrial Emission) was also initiated under this call, with an initial set of three countries.
For the third call down (DG CLIMA, August 2013- May 2014), Directive 2009/29/EC is checked for transposition. This Directive amends Directive 2003/87/EC establishing a scheme for greenhouse gas emission allowance trading within the EU in order to promote reductions of greenhouse gas emissions ‘in a cost-effective and economically efficient manner’. This call down covers 15 Member States.
The fourth call down (DG ENV, November 2013-May 2014) covers the analysis of various directives in the area of environment, with a strong focus on the transposition of Directive 2010/75/EU (Industrial Emissions Directive – 13 countries), and Directive 2010/63/EU (Laboratory Animals Directive- seven countries). This call down includes 29 conformity studies.
