Study for an impact assessment of an amendment of the Insolvency Regulation (EC) No 1346/2000

This study assesses the potential impacts of a range of policy options revising Council Regulation (EC) No 1346/2000 on insolvency proceedings. In order to identify possible options, a full mapping of the problems encountered with respect to cross-border insolvency proceedings was carried out.
Key objectives within the field, fundamental rights issues, and aspects relating to the EU’s right to act were also considered.
Based on consultation and wider research, a number of policy options were developed which were then shortlisted before being assessed for the potential economic, legislative, administrative and fundamental rights impacts (costs and benefits).
The results of this assessment and further consultation were used to put forward recommendations for a preferred policy option to revise the Insolvency Regulation.
